Q. The broker has a buyer who would like to write an offer with seller financing, basically offering a three-year land contract, for the purchase of the seller’s vacation home. Can broker do this in the financing contingency in the offer? How to proceed?


A. The DFI previously indicated that if the property is the seller’s residence, then it is an exempt transaction and neither the parties nor the brokers need a mortgage loan originator or other mortgage license.


The DFI has recently confirmed that a vacation home is considered to be the seller's residence. The term “residence” is being interpreted broadly to include more than just the seller’s principle residence. In the transaction described, the property is the seller’s vacation home which is considered a residence. Therefore, the transaction will be exempt under the DFI tests and no mortgage licenses are needed.
