4th Annual Chili Cookoff and Halloween Costume Party
Join us for our annual Halloween party on Friday, October 29 from 11am to 1pm in the KW West Training Center! All agents are welcome to participate in the chili cookoff as either a contestant or judge. Don't forget your Halloween costume!

Awards will be given out for Hottest Chili, Most Unique Chili, and Best Chili. Current cookoff contestants include Jessica Fox, Susan Katzenmeyer and Peter Zarov... Does your chili recipe have what it takes to win?

Chefs and judges are asked to register at the front desk.

A $5 donation is requested for this all-you-can-eat event. All proceeds will be donated to KW Cares.

WRA Legal Hot Tip
Q. The broker listed a condominium unit as a short sale and the seller has an accepted offer. The seller used the state approved Addendum SSO to the Offer to Purchase-Short Sale. The broker received an approval letter from the lender but the seller is not happy with the terms the lender is offering her; she wants to speak to her attorney before she agrees to the terms. The lender tells the broker that the terms between the lender and the seller are separate from their approval. There is already an amendment to the offer from the lender. The lender will release the collateral but they want to renegotiate the note with the seller.

When does the listing broker notify the buyer’s agent that seller has received the lender approval? The seller has not given the broker her approval and wants to wait until she speaks with her attorney. What are the fiduciary duties to the seller? In reading the language on the SSO Addendum on lines 16 - 20, the broker believes the seller has five days. Is this correct?

A. It is appropriate for the seller to consult with her attorney about the terms and conditions of the lender’s offer, both as to the release the property and renegotiation of the promissory note. It is possible that the lender will approve the release of the property only if the seller agrees to pay the deficiency or some portion thereof.

Line 18 of the WRA Addendum SSO states that if the short sale is not approved by all lenders, or the terms and conditions a lender’s approval are not acceptable to the seller, then the seller may terminate the offer. The seller by contract has agreed to termination not later than five days after the seller receives written notice of the lender’s action or inaction. The broker may recommend that the seller immediately let her attorney know about the deadline language and provide the attorney with a copy of the offer and the lender’s proposals.

The WRA Addendum SSO is not a Department of Regulation and Licensing approved form. Rather, it has been drafted as a tool to use in short sale transactions. The only forms that are state-approved bear the WB mark in the upper left hand corner.
