WHAT TO DO IF AN AGENT IS USING AN OLD OFFER FORM
REALTORS® have all made the shift and are using only the updated versions that became mandatory on July 1, 2011 for the WB- Residential Offer to Purchase, the WB-13 Vacant Land Offer to Purchase and the WB-14 Residential Condominium Offer to Purchase. The next issue likely to come up is what should REALTORS® do if another agent submits an offer using the older version of the DRL-approved form?

The first thing to remember is that REALTORS® should not undertake the role of the "forms police" and reject offers just because they are written using the improper version of the form. Based on license law, REALTORS® should present promptly all offers received (see Wis. Admin. Code § RL 24.13). At that point the listing agent may explain to the seller the advantages and disadvantages of the terms as drafted on the old offer form. The drafting agent could face possible DRL disciplinary action for failure to use the new offer form because Wis. Admin. Code § RL 16.06(7) provides, "A licensee shall use the latest approved version of an approved form." However, at the time the offer is submitted the goal is to help the parties come to terms -- a call to the agent's broker or filing a complaint can wait until later.
