WRA Legal Hot Tip
Q. How long do brokers have to maintain copies of our agents’ real estate CE documentation? The broker has copies of his own going back to 2002 and further and wants to throw out what is not needed.
A. Wis. Admin. Code § RL 15.04, “Retention of Records,” states that a broker shall retain, for at least 3 years, exact and complete copies of all listing contracts, offers to purchase, leases, closing statements, deposit receipts, cancelled checks, trust account records and other documents or correspondence, including inspection reports, received or prepared by the broker in connection with any transaction. The retention period shall run from the transaction closing date or, if the transaction has not closed, from the date of the listing."
Although it would seem like 3 years would be the ideal retention period per Wis. Admin. Code RL 15.04, the DRL recommends that an individual’s certificates of attendance from CE course the person has completed should be retained for 5 years. Licensees should keep in mind that the DRL does conduct a random license renewal audit.
